For Norweigan Customers - Terms of use for the Tollit App

Thank you for using Tollit. Below are our terms and conditions for the use of Tollit, including the app that you are currently using and the service that Tollit makes available to handle customs clearance and parcel handling. It is important that you familiarise yourself with the terms and conditions so that you know what you can and should do, and what you cannot do, and Tollit's responsibilities.

As a user of Tollit and by registering an account with us, you accept the Terms of Use. The Terms apply as an agreement between you and Tollit regarding the services of Tollit. If you do not accept the Terms, you may not use Tollit.

If there are any terms you cannot accept or if you have any questions, please contact us. You can find our contact details at the bottom of the terms and conditions.

Use of Tollit

To use Tollit, you need to register in the app to create an account by entering your name and contact details. We retrieve what you have bought and the price from the online shop you have shopped in, which is necessary for us to carry out the customs clearance for you. The payment transaction is carried out through a payment service provider and we do not receive any information about your debit or credit card etc. except that the amount for the services has been reserved and paid.

To use Tollit you must be at least 18 years old. If you are not 18 or older, you must ask your parent or guardian to manage the use of Tollit.

Customs can only be used by consumers and not for commercial purposes.

It is important that you enter the correct information about yourself so that you can receive the shipment correctly, i.e. to you at your address, and so that your shipment can be cleared through customs correctly. If incorrect information is provided, we may have to suspend the shipment or close your account.

You are responsible for the account once it is created, so you are also responsible for ensuring that others do not obtain your account password. If you suspect that others can or have had access to your account, you should change your password and let us know as soon as possible.

If we consider that your use of Tollit entails a higher risk shipment, we reserve the right to require you to provide proof of identity or information about the card used when using the service. We also reserve the right to refuse such shipments. We will endeavour to contact you in such cases, but if we are unable to contact you, we will reject the use of the service and the shipment.

You must not violate any laws and regulations applicable to Tollit, including these Terms and Conditions. You must also not do anything that may affect the functionality, services or security of Tollit. If a breach is detected, this may be reported to the appropriate authorities and your account will be suspended or closed.

In-app payment

The costs for using Tollit are shown in NOK in the app. The estimated amount for customs clearance, including VAT and customs duties, is estimated in relation to payment in check-out. The customer chooses the specified shipping method and the price for shipping is added to the cost of goods. The total cost of using Tollit-pay, including the price of the goods, the estimated cost of customs clearance and freight will be reserved on the debit or credit card used. Reservation is estimated to be about 7 days, as you need to calculate the time for delivery of the goods until arrival in Norway. The actual capture of payment/execution of payment will not take place until the goods have arrived in Norway and the goods have cleared customs in Norway.

When your parcel arrives in Norway, you will receive information showing the tracking number for your shipment. For some online stores that are linked to Nordic freight forwarders, the tracking number will appear in the app at the time of dispatch.

Your parcel will be placed in a customs warehouse until you have completed the BankID verification related to customs clearance. You will receive a copy of the customs declaration in the app when customs clearance is approved. Invoices from purchases in the online store will also be available in the app.

Your rights

Your rights are set out in these Terms and Conditions, as well as the laws and regulations applicable to the service provided by Tollit (which are set out in these Terms and Conditions, but may also be set out in other laws and regulations). See also your rights relating to cancellation and personal data below.

Tollit will keep your invoices from online shops and customs declarations, and any other documentation or information, in the archive on the app. You can delete this information and documentation yourself by deleting your registered profile in Tollit, but please note that this may affect the services provided by Tollit and may result in information and documentation no longer being available. If Customs needs documentation and information, such as in connection with enquiries from the authorities, accounting or otherwise, Customs will retain information and documentation until this need no longer exists.

Right of cancellation

You have a right of withdrawal for 14 days from the day on which you use a service from Tollit was entered into in accordance with the Act of 20 June 2014 No. 27 on the duty of disclosure and right of withdrawal in connection with distance selling and sales outside permanent business premises (the Cancellation Act).

The characteristics of the services provided by Tollit are set out in these Terms and Conditions and on the Tollit website and app.

The service provider is Customs, see below for contact details.

The total price of the services including taxes is displayed in the app when ordering services. Please note that some of the services also include expenses for customs clearance and freight. Reimbursement of the customs declaration must be handled by you with the customs authorities if customs clearance has already been completed. Cancellation rights towards the freight supplier must be taken up with the freight supplier.

The standardised form for exercising the right of withdrawal (withdrawal form), as well as the conditions, time limits and procedures for exercising the right of withdrawal are set out in the form available on tollit.no.

If you exercise your right of cancellation after the services have started, you will have to pay for services already incurred when you exercise your right of cancellation and other reasonable costs.

Data and privacy

You have all rights to the data and information that you enter into Tollit or that arise in Tollit as a result of your use of the Service. You can modify or delete this data, but this may result in Customs being unable to fulfil its services for you.

Norwegian Customs is the data controller (i.e. responsible for the processing of personal data) for the service for the personal data that you enter as well as data that Norwegian Customs collects, e.g. from the online shop you use to handle customs declarations and communication to the freight supplier. See below for contact details.

Tollit respects your privacy and will not use your personal data in any other way than you have been informed of and have agreed to. For information on how personal data is processed, please see Customs' privacy policy at tollit.no.

Tollit's rights

Customs may change the content and functionality of the App and the Service at any time and without further notice. However, we take feedback from our users and suppliers seriously and listen to you.

Tollit may suspend, ban and/or delete the accounts of Users or Providers who violate the laws and regulations applicable to Tollit's services, as well as to Tollit's Terms and Conditions, or for other reasons incompatible with the use of Tollit and Tollit's services.

Tollit, Tollit's trademarks, solutions, including the Service and Apps, and other intellectual property rights, whether registered or not, are protected by copyright and other intellectual property laws. You shall not review the Service, App or anything else provided by Tollit for the purpose of discovering how the Service and App work. This right applies for as long as you use Tollit and cannot be exercised in any other way than to use Tollit and Tollit's services.

You have a right to use the Service and the App, as well as the underlying software, as long as you comply with these Terms. By using Tollit, you accept this.

Responsibilities and disclaimers of Customs

Tollit only provides its services for customs clearance and contact between the carrier of your shipment. Customs does not take responsibility for the online store you have shopped in, including whether you get the right item and other matters related to the item. You are responsible for checking whether there are any restrictions on the import of goods. The terms and conditions for the online store are stated in the online store you shop in. Through the app, you can access one or more alternative shipping providers. Customs only facilitates contact with these freight providers and does not take responsibility for the freight and the freight provider. The terms and conditions of the shipping provider will appear before you choose the shipping and shipping provider.

It is emphasised that Tollit is not a representative of the suppliers, including online shops and/or freight suppliers, that you use, see section 1, third paragraph of the Consumer Purchases Act, and Tollit only carries out customs clearance and mediates contact with freight suppliers. Tollit is therefore not jointly and severally liable with online stores, sellers, freight suppliers or others you have contact with as a result of your purchase. This applies even if payment is made via Tollit's payment and invoicing solutions. Tollit is not responsible for links to services that are not provided by Tollit or that are outside the app.

Tollit is a service under development, and although we do our best to develop the service, there may be functions and solutions that do not work properly or that the service is not available at all times. If you notice something about Tollit that does not work properly, we also ask that you let us know so that we can look into it and possibly make changes.

Tollit's liability is in any event limited to direct losses and costs, and you may not make claims for indirect losses, including, inter alia, loss of turnover, loss of profits of any kind, loss of data, costs and losses due to business interruption, loss of use and claims from third parties. Tollit is only liable for its own services and not for matters relating to the online shop and shipping provider, see above.

In any event, Customs' liability is limited to the fee received by Customs for its services, less the amount paid by you to Customs for customs clearance and shipping, which are expenses that Customs passes on to the customs authorities, the online shop and the shipping company respectively.

Laws that apply

Tollit is a Norwegian company and we are based in Oslo. These terms and conditions are therefore governed by Norwegian law and Norwegian laws, and if we have a dispute, it will have to be resolved in Oslo, unless there are rules that require the dispute to be resolved elsewhere, such as under the Dispute Act.

Changes to the terms and conditions

It will be necessary to change these terms and conditions from time to time, including the price of the services. If there are changes to the terms and conditions that are important to you, we will inform you by email. Prices for customs clearance and shipping are beyond our control and are subject to change without notice. You will always find updated terms and conditions in the app or on the website at tollit.no. If you continue to use Tollit after changes to the terms and conditions, it means that you accept the terms and conditions with changes.
